Make a tobacco or vaping complaint

To complain about a tobacco or vaping breach in Tāmaki Makaurau Auckland or Te Tai Tokerau Northland please use the form below. We will not inform the company, organisation or store of your personal details and these will be treated in confidence. We may contact you for further details.

The National Public Health Service is responsible for enforcing the Smokefree Environments and Regulated Products Act 1990. This prohibits the sale of tobacco and vaping products to minors, restricts the marketing of tobacco and vaping products, and requires most indoor public places to be smokefree and vapefree.

If you have information on any potential breaches of the law we would like to hear from you.

 

WHAT WE INVESTIGATE

We can investigate complaints on:

  • The sale and supply of tobacco, herbal smoking and vaping products to minors (under 18 years old)
  • The retail display of tobacco and vaping products
  • The advertising of tobacco and vaping products
  • Smoking and vaping in workplaces
  • Smoking and vaping in all hospitality venues and certain public places (such as premises with a licence to sell alcohol)
  • Smoking and vaping in schools, kura and early childhood centres
  • The sale of toy tobacco and vaping products

Under the Smokefree Environments and Regulated Products Act 1990, it is not illegal for people to smoke or vape in most outdoor public places, for instance, public footpaths. We are also unable to investigate complaints about tobacco or vaping within a private residence.

  • To complain about a vaping product, vaping substance, vaping device, or adverse reaction to a vaping product please contact the Vaping Regulatory Authority (VRA).
  • To complain about a smoked tobacco product please contact the Tobacco Regulation Authority (TRA).
  • To complain about a retailer or incident outside of Tāmaki Makaurau Auckland or Te Tai Tokerau Northland please contact your local public health service.
